Polidori's Plan Cracks Down on Unsafe Cell Phone Use

Cell phone restrictions would protect Michigan motorists

LANSING – In an effort to cut down on dangerous distracted driving, State Representative Gino H. Polidori (D-Dearborn) today introduced a bill to limit the use of cell phones on Michigan roads. House Bill 4982 would prohibit making or receiving phone calls while operating a motor vehicle; the restriction also would apply to text messaging. The bill has an exception for drivers who use hands-free devices.

"Cell phones are a distraction to drivers, and a safety hazard to everyone," Representative Polidori said. "Cutting down on distracted driving will prevent accidents and save lives."

The bill would make cell phone use a secondary offense, meaning that a ticket can be issued only if the driver has been pulled over for a different violation, such as speeding. A violation would result in a $100 fine; no points would be added to a driver's record for a violation.

"This legislation is consistent with our standards of road safety here in Michigan," Polidori said. "The state has seatbelt laws to protect drivers, and we prohibit drunken driving to eliminate threats to other drivers and innocent bystanders. A cell phone restriction would serve both purposes."

The legislation offers exceptions for drivers who use a phone to report an accident, a road hazard, or a potential criminal act. It also allows police, fire, and emergency personnel to use phones when carrying out official duties.

Several other states and municipalities have adopted similar proposals. Connecticut, the District of Columbia, New Jersey and New York already have banned the use of cell phones while driving. A California law is scheduled to take effect in July 2008. In Michigan, the city of Dearborn passed an ordinance earlier this year that would levy a $100 fine on any driver caught on a cell phone.

House Bill 4982 was referred to the House Transportation Committee.
